General conditions

Any bookings for tours or travel, including without limitation, for airfares, cruises or packages incor- porated in this brochure (“Travel”) made by a client or customer (“You”) with an employee or con -tractor of CURACAO TRAVEL are subject to the following general conditions (“General Conditions”) together with the terms and conditions annexed to the itinerary c onfirmation.

Reservations and Payment:

A deposit and a signed itinerary confirmation are required at the time of booking. Upon payment of a deposit, You indicate acceptance of the General Conditions. The amount of the deposit will depend on the package booked. At Curacao Travel sole discretion full payment may be required 45 days prior to departure; reservations made within 60 Days of departure are subject to immediate payment in full; or such other time as Curacao Travel notifies You from time to time. If You are part of a group and have a group representative, your group representative is responsible for advising the group of any/all cancellation penalties. Any person or entity, with whom You deal to book your Trav -el, does so strictly as your agent. Curacao Travel disclaims liability for payments made to anyone (including such person or entity appointed as your agent), until we receive such payment earmarked for your account and we accept it as such.

Travel Documents

Documents will be mailed approximately 21 days prior to departure if payment in full is made at least 60 days prior to departure. Documents will not be released until full payment has been received. Late payments may require express shipping charges to be billed to the recipient.


Cancellations and Refunds.

All refunds are subject to cancellation charges of up to 100% of the cost of the Travel. Detailed deposit and cancellation information will be furnished upon booking. We strongly recommend trip cancellation insurance. All refunds are conditioned upon your understanding that your acceptance of a refund is on the express condition that You release Curacao Travel from any and all liability and You thereby waive all additional rights and remedies under your contract or any applicable state, federal or foreign law.

Revision/Changes.

CURACAO TRAVEL may charge customers for revisions or changes, however, additional charges may be imposed by airline or hotel. Not Included in Package Price.Our price for Travel does not include porterage at airport (unless specified) and hotels; tips to local representative, sightseeing guides, Restaurant employees, hotel bellman and chambermaids, wines, liquors, laundry or any other items not specifically mentioned within Itinerary. Tipping is left to your discretion. In addition, price for Travel are subject to holiday blackouts, peak period and surcharges and Other restrictions may apply and vary by resort, cruise and airline carrier.

Refunds for Unused Services.

Unused hotel nights are refundable only if they cover a minimum of two consecutive nights and only to the extent that the tour Operator receives a refund from the hotel after deducting cancellation charges levied by the hotel, if any. Unused transfers and/or Sightseeing tours included in the basic tours will only be refunded to the extent that the tour operator receives a refund from the supplier. To get a prompt refund for unused services, clients are requested to submit to their agent written proof from the hotel or other operator that services were unused and refundable. A check-out bill from the hotel in question will be accepted in lieu of special certification. If no proof is furnished, a refund may be made pending an investigation, which may take up to three months. To be accepted, all refund claims should be presented to the travel agent who initially booked the tour, no later than 30 days after the trip has ended. No refunds or adjustments will be made for any changes, cancellations or modifications of services provided In this itinerary, if such changes are made by the tour participant during the tour. All refunds are conditioned upon your understanding that You release CURACAO TRAVEL from any and all liability and You thereby waive all additional rights and remedies under your contract or any applicable state, federal or foreign law.

Local Taxes and Service Charges.

Local room tax, energy surcharges and service charges on room and meals are not included unless specified. Taxes and service Charges are based on the hotel’s daily room tariff and not on the land package prices.

Participating Carriers.

These packages are sold in conjunction with the services of approved ARC and IATA member carri -ers. Government regulations now enable air carriers to increase their fares on 24-hour notice.

Airfare.

Price listed in this brochure does not include air transportstion to and from the start of your vacation. If and when air transportation is part of the package, air fuel surcharge is included in pricing. Some fares may be non-refundable but may be exchanged for a fee, plus any additional Airfare costs due to difference in new airfares. Airlines offer varied promotional fares to the destinations included in this brochure. A minimum stay and advance purchase/ticketing is required. Holiday supplements are applicable and further restrictions may apply. Some airlines impose additional charges if you choose to check any baggage. Please contact your airline for more information Regarding airlines checked baggage policies.

Responsibility.

Curacao Travel and its employees, shareholders, subsidiaries, affiliates, officers, directors, succes - sors, agents and assigns does not own or operate any entity which provides goods and services for Your travel including without limitation, lodging facilities, airline, vessel, motor coach, or other transportation companies, guides or guide services, local ground operators, providers or organizers of optional excursions, food service providers, etc. All such persons and entities are independent contractors and are in no way affiliated to CURACAO TRAVEL or any of CURACAO TRAVEL affili -ated entities. As a result, CURACAO TRAVEL is not liable for any negligent or willful act or failure to act of any such person or entity or of any third party. In addition and without limitation, CURACAO TRAVEL is not responsible for any injury, loss, death, inconvenience, delay, or damage to person or property in connection with the provision of any goods or services whether resulting from, but not limited to, acts of God or force majeure, illness, disease, acts of war or civil unrest, insurrection or revolt, animals, strikes or other labor activities, Criminal or terrorist activities of any kind, overbook -ing or downgrading of accommodations, mechanical or other failure of airplanes or other means of transportation, or for any failure of any transportation mechanism to arrive or depart on time. Also be advised that certain foreign facilities such as air-conditioning systems in public places, hotels and motor coaches are not up to U.S standards. CURACAO TRAVEL reserves the right to withdraw any program or Travel in this brochure and/or make such changes in the program(s) or Travel. If due to weather, flight schedules or other uncontrollable factors You are required to spend additional night(s), You will be responsible for your own hotel, transfers and meal costs. Baggage is entirely at owner’s risk.

Important Notes-Consult Agent.

PROOF OF CITIZENSHIP: Be prepared with proper documentation! United States citizens are re -quired to have a valid passport to travel internationally. Visit http:www.travel.state.gov for informa -tion on how to obtain a passport, including forms, fees, and how to locate a passport acceptance facility nearest You. No Refunds will be made if improper documentation results in denied boarding or entry, If You are not a U.S citizen be certain to check with the consulate of the country You are traveling to for full entry requirements. (Visas may be required in addition to passports). Require -ments may change after this printing so we recommend that you verify any immigration require -ments with the tourist office or consulate before you travel.

Travel Protection Plan.

To safeguard yourself against cancellation charges and additional expenses you may incur before and after the departure of your trip, it is always recommended that you purchase travel 
insurance protection plan.

Travel consumer restitution fund disclosure:

For customers who purchase from within the State of California: This transaction is covered by the California Travel Consumer Restitution Fund (TCRF) if the seller of travel was registered and participating in the TCRF at the time of sale and the customer is located in California at the time of payment. Eligible customers may file a claim with TCRF if the customer is owed a refund of more than $50 for transportation or travel services that the seller of travel failed to forward to a proper provider or such money was not refunded to you when required. The maximum amount that may be paid by the TCRF to any one customer is the total amount paid on behalf of the customer to the seller of travel, not to exceed $15,000. A claim must be submitted to the TCRF within 12 months after the scheduled completion date of the travel. A claim must include sufficient documentation to prove the claim and a $35 processing fee. Claimants must agree to waive their right to other civil remedies against a registered participating seller of travel for matters arising out of a sale for which they file a TCRF claim. The traveler may request a claim form by writing to: Travel Consumer Restitution Corporation, P.O. Box 6001, Larkspur, CA 94977-6001. For customers purchasing from outside of California: This transaction is not covered by the California Travel Consumer Restitution Fund.

Reservations and payment:

Special payment policies may apply and will be advised at time of reservation. If payment is not received by the due date, airline and all other reservations will be cancelled. Curacao Travel is not responsible for any penalties, fare increases or fees incurred due to any changes once package or air tickets have been purchased.

Forms of payment:

Payment may be made by using Curacao Credit Card, debit and credit cards from American Express, Visa, MasterCard, Diners Club, or Discover Card.

Last minute reservations:

Reservations are accepted up to the day of departure, subject to availability. International destinations may require up to three days' advance notice. A special handling fee of $30 will be assessed to reservations accepted within 10 days of departure for Hawaii, Costa Rica and Caribbean. A special handling fee of $50 per booking will be assessed to reservations accepted within 30 days of departure for Tahiti, Fiji and the Cook Islands.

Customer identification and proof of citizenship:

The Transportation Security Administration (TSA) requires all airline passengers traveling on and after November 1, 2010 to provide the following Secure Flight Passenger Data (SFPD) regardless of when the reservation was booked:

  • Full Name as it Appears on Government-Issued I.D.
  • Date of Birth
  • Gender
  • Redress Number (If Available)
  • Documents:

    Documents will be issued on fully paid reservations approximately 21 days prior to departure. Fees apply for the replacement of lost or destroyed documents and for expedited delivery. Changes prior to departure: Curacao Travel will assess a fee for each customer initiated change to the reservation after receipt of payment, and additional airline, hotel and/or supplier fees may also be charged. Any change made will result in the reservation being re-priced at the rate in effect at the time of the change. A "name change" constitutes a cancellation and cancellation fees will apply.

    Cancellations and Refunds.

    No shows:

    Failure to travel without prior notification is considered a no-show and the entire cost of reservation is non-refundable, subject to policies and procedures of the providers of travel and accommodations.

    Changes after departure:

    No refunds will be granted on unused services once travel has commenced. Curacao Travel will assess a $100 per person fee for changes made after commencement of travel. Changes in return transportation to the extent permitted by carrier(s)' tariff may be made only through Curacao Travel’s representatives. Changes in travel arrangements that result in additional monies owed due to price differences, fuel surcharges, ticket re-issuance fees, etc. are due and payable directly to Curacao Travel;s representatives at time of change.

    Travel Consumer Restitution Fund Disclosure.

    For passengers who purchase from within the State of California.     Rates:

    All rates are quoted in U.S. Dollars unless otherwise noted. Rates are subject to change at any time, without notice. Curacao Travel reserves the right to make adjustments if a particular rate was incorrectly stated. Curacao Travel can guarantee rates only for reservations paid in full; it is therefore recommended that full payment be made at time of booking. Airline tickets must be issued to guarantee against rate increases, fuel surcharges and to avoid cancellation of airline reservations. Government and supplier-imposed taxes and fees are subject to increase at any time and are not covered by Curacao Travel.

    Rates do not include:

    Airline baggage or seat assignment fees or other ancillary fees, passport and visa fees, some departure taxes, gratuities, meals, beverages, resort fees, parking fees, insurance, telephone calls, additional bedding charges, laundry service, and other miscellaneous charges of a personal nature are not included except where specifically noted.

    Air transportation:

    Curacao Travel has no control over and assumes no liability for airline strikes, schedule changes, flight delays, flight cancellations or other airline initiated changes. In the event of such an occurrence, the airline is responsible and will determine what action will be taken.

    Accommodations:

    Facilities, guest services, amenities, hotel energy surcharges, resort fees and promotional offers are provided at the discretion of the hotel/cruise line and are subject to change without notice. Any additional costs are the responsibility of the customer and are payable directly to the hotel/cruise line. Room/cabin location and bedding requests are not guaranteed and are based upon availability at time of check in. Hotel/cruise ship descriptions and photos do not necessarily depict the actual room/cabin in which guests will be accommodated; maps and images may not be exact or to scale, and are for general description purposes only. Room/cabin standards are the sole responsibility of the hotel/cruise line. Hotel/cruise ship ratings are based on information provided by the hotel/cruise ship and Curacao Travel’s own evaluations.

    Rental cars:

    Each rental day consists of one 24-hour period. Overtime charges must be paid directly to the car rental company (CRC). Car rentals do not include gas, collision damage waiver, drop charges, personal accident insurance, personal effects protection, car seats, additional driver fees, upgrades or extensions of rental beyond the period included. All CRC claims must be settled directly with the CRC. NOTE: A valid driver's license and security deposit must be provided to the CRC. Minimum driver age varies by destination and type of vehicle. Underage drivers may be subject to an extra surcharge payable directly to the CRC.

    Baggage and Personal Property:

    Baggage checked or carried on board an aircraft, vessel or vehicle are subject to fees based on weight, number and size. All baggage fees are the responsibility of the customer and are payable directly to the supplier. Please contact the supplier for their current baggage policy. Curacao Travel is not responsible or liable for any delay, loss or damage to baggage and personal property.

    Physical disabilities:

    Customers requiring special facilities, services or accommodations must disclose such needs to Curacao Travel at time of reservation. Wheelchair-accessible transportation and accommodations may be requested, but cannot be guaranteed. Available accommodation standards vary by hotel/cruise ship and are not within the control of Curacao Travel. Your foreign destination may not conform to the United States' Americans with Disabilities Act requirements, and facilities for disabled persons may be extremely limited. Curacao Travel assumes no liability for the failure for the provision of accommodations by a travel vendor.

    Responsibility:

    Curacao Travel is only responsible for reserving the items listed in the reservation details. The suppliers providing transportation, sightseeing arrangements, tours, excursions and accommodations ("Suppliers") for the vacations are independent contractors and are not agents, affiliates, representatives or employees of Curacao Travel, or any of its subsidiaries, related companies, or parents (Adir International LLC). Curacao Travel has no ownership interest in any Supplier. Any use of the Curacao Travel name by a Supplier is for identification purposes only and does not constitute ownership, agency, supervision or control by Curacao Travel. All documentation, receipts and tickets are issued subject to the terms and conditions specified by the Supplier. By utilizing the services of the Suppliers, you agree that neither Curacao Travel nor any of the Curacao Travel Parties shall be liable for (1) any accident, loss, injury or damage to you or to those traveling with you in connection with any accommodations, transportation or other services or resulting directly or indirectly from any occurrences or conditions including, but not limited to, negligence, defects in vehicles, equipment malfunction, strikes, "Acts of God," riots, terrorist acts or threats, wars, acts of governmental authority, theft, delays, weather conditions, environmental conditions, bankruptcy, cancellations or changes in itineraries or schedules or (2) loss or damage to property or injury to persons, caused by reason of any act or omission, intentional, negligent or otherwise by such third party Suppliers. Curacao Travel makes no implied or express warranties in the offering of any vacation described in these materials. Remember that all travel documents and required personal identification, as well as compliance with agricultural regulations, are your responsibility. The terms under which you agree to take a vacation cannot be changed or amended except in writing, signed by an authorized officer of Curacao Travel. The customer contract in use by the airline, when issued, constitutes the sole agreement between you and the airline. Curacao Travel, reserves the right to decline to accept or retain any person as a member of the vacation at any time prior to departure or during the course of the vacation. In the unlikely event that the services or accommodations are not available as stated, due to reasons beyond Curacao Travel’s control, efforts will be made to provide services or accommodations of equal standard and quality. Refer to the travel information enclosed with travel documents for assistance once travel has commenced or contact our Customer Service Department at Curacao Travel, 1605 W. Olympic Blvd. Suite 600, Los Angeles, CA 90015 in writing within 30 days of your return regarding service issue disputes. In those cases where a refund is warranted, all unused documentation must be returned in order to process the refund.

    Limitation of liability:

    By making a reservation, customer acknowledges that in all events, Curacao Travel shall not be liable for any incidental or consequential damages and that the sole extent of Curacao Travel’s liability, if any, shall never exceed the amount actually paid by customer to Curacao Travel.

    Arbitration:

    Any dispute arising out of, or relating to, any vacations offered shall be submitted to non-binding arbitration under the Federal Arbitration Act. To the extent that the Federal Arbitration Act either is inapplicable or held not to require arbitration of a particular claim or claims, California law pertaining to agreements to arbitrate shall apply and the arbitration shall be conducted under the terms of the California Code of Civil Procedure. Each party shall pay for its own costs, arbitration fees and attorneys' fees, if any.

    California Seller Of Travel:

    Curacao Travel is a Registered Seller of Travel with the State of California. CST number 2058910-50. Registration as a seller of travel does not constitute approval by the State of California.

    These Terms and Conditions of Sale are not applicable to groups or special interest packages.
